1. Acceptance of Terms
By downloading or using WineMenu.ai (the "App" or "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a binding agreement between you and WineMenu.ai.
2. What the Service Does
WineMenu.ai is a mobile application for iOS that allows you to scan restaurant wine menus using your phone's camera. The App uses AI to identify wines on the menu and displays estimated retail prices sourced from Wine-Searcher, along with a calculated markup vs. the restaurant price. The App is intended for informational use only.
3. Accuracy Disclaimer — Wine Prices Are Estimates
Wine prices displayed in the App are estimates only. Retail pricing data is sourced from Wine-Searcher and reflects average or recent market prices from third-party wine retailers. These prices may not reflect your local market, may be outdated or incomplete, and do not account for taxes, shipping, or retailer-specific pricing.
Wine identification may also be imperfect — menu text recognition and AI parsing can produce errors, especially for unusual formats, handwritten menus, or wines with ambiguous names.
Do not make purchasing or financial decisions based solely on information provided by this App.
4. Subscription Terms
Free tier. The App offers a free tier that includes a limited number of menu scans. Free tier limits are subject to change with notice.
Paid subscription. A paid subscription removes scan limits and may include additional features. Subscriptions are offered on a monthly or annual basis and are priced as displayed in the App at the time of purchase.
Billing. All subscriptions are billed through Apple In-App Purchase. Your Apple ID account will be charged upon confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
Free trials. If a free trial is offered, unused trial time is forfeited upon purchasing a subscription.
Price changes. We may change subscription pricing at any time. Changes will not affect your current billing period and you will be notified before the change takes effect.
5. Cancellation Policy
You may cancel your subscription at any time through:
iOS Settings → [Your Apple ID] → Subscriptions → WineMenu.ai → Cancel Subscription
Cancellation takes effect at the end of the current billing period. You will not receive a prorated refund for unused time. After cancellation, you retain paid access until the end of the paid period, then revert to the free tier. Refund requests are handled by Apple in accordance with Apple's refund policies.
6. License
WineMenu.ai grants you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal iOS device for personal, non-commercial purposes. You may not copy, modify, distribute, reverse-engineer, or use the App for commercial purposes without written permission.
7. Acceptable Use
You agree not to use the App to violate any applicable law, infringe the rights of any third party, or attempt to gain unauthorized access to any part of the App or its infrastructure. You may not use automated means to scrape or extract data from the App.
8. Intellectual Property
All content, design, code, and data in the App are the property of WineMenu.ai or its licensors and are protected by applicable intellectual property laws. Wine pricing data is sourced from Wine-Searcher and may not be exported or redistributed.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT WINE PRICING DATA OR IDENTIFICATION RESULTS WILL BE ACCURATE OR COMPLETE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WINEMENU.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING RELIANCE ON PRICING DATA OR WINE IDENTIFICATION RESULTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10 USD, WHICHEVER IS GREATER.
11. Third-Party Services
The App integrates with Anthropic, Wine-Searcher, Google, and RevenueCat. Your use of those services is subject to their respective terms and privacy policies. WineMenu.ai is not responsible for the practices or availability of any third-party service.
12. Termination
We may suspend or terminate your access to the App at any time for conduct that violates these Terms or for any other reason at our discretion. Upon termination, your license to use the App ceases immediately.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York, and you consent to personal jurisdiction in those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this document. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
